AUSTRALIAN CONSUMER LAW

- Goods match any sample or demonstration model
- Services are rendered with due care and skill
- Services are fit for the specified purpose
- Services will be completed within a reasonable time

Our liability for any breach of a consumer guarantee that cannot be excluded is limited to, at our option:
- For goods: replacement, repair, or refund of the purchase price
- For services: re-supply of the services or payment of the cost of having the services supplied again

This limitation does not apply where the failure constitutes a major failure under the ACL.

If we cancel your order after payment, we will provide a full refund.

DISPUTE RESOLUTION

Governing Law
These Terms are governed by the laws of Tasmania, Australia. You irrevocably submit to the non-exclusive jurisdiction of the courts of Tasmania.

Complaints Process
If you have a complaint:

2. We will acknowledge your complaint within 2 business days
3. We will investigate and respond within 14 business days
4. If you are not satisfied with our response, you may contact Consumer Affairs Tasmania or seek independent legal advice

Alternative Dispute Resolution
If we cannot resolve a dispute through our complaints process, you may refer the matter to an alternative dispute resolution provider. We may also suggest mediation or other forms of alternative dispute resolution.

SEVERABILITY

If any provision of these Terms is found to be invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

ENTIRE AGREEMENT

These Terms, together with our Privacy Policy, Return and Refund Policy, and Shipping Policy, constitute the entire agreement between you and Al Manuka regarding your use of the Website and purchase of products.

WAIVER

Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.

ASSIGNMENT

AUSTRALIAN CONSUMER LAW NOTICE

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
